48 hour cancelation policy: (Applies to all Private Lessons/No-make-ups for group lessons unless noted otherwise, i.e., inclement weather, Coach emergency): Please give Coach Cole notice via e-mail and text if you cannot attend the prescheduled lesson so a make-up can be scheduled. If he receives notice in less than 48 hours or no notice at all, your pre-scheduled lesson is considered used.

Time minimum per week policy: (1.5 hour per week Private Lesson and or 1.5 hours per week Group Lesson). This insures adequate progress for each student.

Make-up policy: (Applies to all Private Lessons) A make-up must be completed within 7 days of the pre-scheduled lesson and is subject to the Coaches availability. Every effort will be made to provide the make-up lesson within reason.

Inclement weather or Coach emergency policy: In these instances a make-up will be provided or a lesson credit will applied to the client. The Coach will contact you with a make-up time/day and or credit.

Payment Policy: Payments are due in full prior to the service being rendered.

Refund Policy: All lessons are non-transferable and non-refundable.

Late Policy: The Coach will wait 15 minutes after the scheduled time for the client(s) to arrive for their lesson. If the client has not arrived after the 15 minutes the lesson is considered used.

Expiration Policy: All lessons purchased by clients expire within 3 months after the date of purchase.

Behavior Policy: Tennis With Cole provides students a safe and positive learning environment. Each student must abide by all Tennis With Cole rules and behave in a socially appropriate manner. Unacceptable behavior may result in dismissal from the program without a refund.

Release, Waiver of Liability & Consent for Medical Treatment/Photo & Video Release Waiver

I am the legal guardian of a child who is participating in a Program instructed by Cole Shelton. I am the participant of a Program instructed by Cole Shelton.

In consideration for being allowed to participate in the Program, I waive my right to sue and release Cole Shelton, its employees, officers, volunteers and agents (collectively Cole Shelton) from liability for, and from, any and all claims, including claims of negligence, resulting in any physical injury or illness, (including death) or any economic loss I may suffer or which may result from my participation in the Program, or any events incidental to the Cole Shelton Program, including travel to and from the Program.

I am voluntarily participating in the Program. I understand that there are risks associated with my participation in the Program, such as physical or psychological injury, illness, disfigurement, temporary or permanent disability, death or economic loss. These injuries or outcomes may arise from my own or others’ actions, inactions, or negligence, or the condition of the Program location or facility. Nonetheless, I assume all risks of my participation in the program, whether known or unknown to me, including travel to and from the Program and any events incidental to the Program.

I agree to hold Cole Shelton harmless from any and all claims, liabilities and costs, including attorney’s fees, as a result of my participation in the Program, including loss or damage to my personal property. If Cole Shelton incurs any of these types of expenses, I agree to reimburse Cole Shelton.

If I need medical treatment as a result of my participation in the Program, I agree to be financially responsible for any costs incurred as a result of the treatment.

I hereby give my permission for Cole Shelton to use my and/or my child(ren)’s photograph/image/video and/or audio recording in its promotions, teaching methods, website and other media. I understand that Cole Shelton has exclusive rights to these visual and audio recordings.

I understand that this document is written broadly and inclusive as legally permitted by the State of California. I agree that if any portion is held invalid or unenforceable, I will continue to be bound by the remaining terms.

I am 18 years of age or older. I have read this document and agree to all of the policies. I understand the legal consequences of accepting this electronic document including a) releasing Cole Shelton from all liability, b) waiving my right to sue Cole Shelton, and c) assuming all risks of participating in the program and any events incidental of the Program.

I am the legal guardian of a child who is participating in a Program instructed by Cole Shelton. I am the participant of a Program instructed by Cole Shelton. I allow the Participant to participate in this Program. I understand that I am responsible for the obligations and acts of the Participant as described in this document. I agree to be bound by the terms of this document.
